This competition was named after late justice R.R. Aggarwal, one of this college’s founding members. And to remember their immense contribution towards legal education, we at Siddhartha Law College host various legal program under the aegis of this name. And this Moot Court is also one of such program.
The 1st edition of this Moot Court dealt with constitutional validity of criminal defamation under Sections 499 and 500 of the Indian Penal Code, juxtaposed against the right to free speech under Article 19(1)(a) of the Constitution. It highlighted a political controversy involving public figures, raising questions about the balance between protecting individual reputations and ensuring democratic accountability. The case debated whether defamation should have remained a criminal offense or been confined to civil remedies, emphasizing the tension between individual rights and societal harmony. The matter invited a constitutional bench to assess the compatibility of these laws with Articles 19 and 21.
